Terms of Service

These Terms of Service (the "Terms") are a binding legal agreement between you and GameServersHub LLC, a Florida limited liability company ("GameServersHub", the "Platform", "we", "us", or "our") governing your access to and use of the website located at gameservershub.com, our public API, and all related services (collectively, the "Services").

By accessing or using the Services, creating an account, uploading content, or completing a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, you must not use the Services.

If you use the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and "you" refers to that entity.

You must be at least 13 years of age (or the higher minimum age required in your jurisdiction) to use the Services. You must be at least 18 years of age, or have the verifiable consent of a parent or legal guardian who agrees to these Terms on your behalf, to make purchases or to sell resources through the Platform.

You may not use the Services if you have previously been banned or removed from the Platform, or if your use would violate any applicable law or sanction program. By using the Services you represent and warrant that you meet all eligibility requirements in this section.

Accounts are created by signing in through a supported third-party identity provider (currently Discord and Steam). You are responsible for maintaining the security of the third-party accounts you use to access the Platform and for all activity that occurs under your GameServersHub account.

• You agree to provide and maintain accurate account information.
• Signing in with Discord may require, and may automatically effect, membership in the official GameServersHub Discord server, as described in our Privacy Policy.
• You must notify us promptly at [email protected] if you suspect unauthorized use of your account.
• We may suspend or terminate accounts that are compromised, shared, automated without authorization, or used in violation of these Terms.

GameServersHub is a venue that allows independent creators ("Creators") to list, distribute, and sell digital gaming resources such as plugins, maps, skins, scripts, and tools ("Resources"), and allows users to browse, download, and purchase those Resources.

Unless we expressly state otherwise, Resources are created, owned, and supported by their Creators, not by GameServersHub. A purchase forms a transaction between the buyer and the Creator; GameServersHub facilitates the transaction, collects a platform fee, and provides hosting and delivery infrastructure, but is not a party to the underlying sale and does not guarantee the quality, safety, legality, compatibility, or fitness for purpose of any Resource.

We do not pre-screen, endorse, or warrant user-submitted content, although we reserve the right to review, approve, reject, or remove any content at any time as described in Section 10.

"User Content" means anything you submit to the Services, including Resources, resource descriptions, images, version files, reviews, wiki pages and revisions, profile information, and reports.

You retain ownership of your User Content. By submitting User Content you grant GameServersHub a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, distribute, display, perform, adapt for technical purposes (for example transcoding, thumbnails, and previews), and otherwise use that content as needed to operate, promote, and improve the Services. This license continues for content already delivered to other users (for example, purchased Resources) even after you remove the content or close your account.

By submitting User Content, you represent and warrant that:

• you own the content or hold all rights, licenses, and permissions necessary to submit it and to grant the license above;
• the content does not and will not infringe or misappropriate any third-party intellectual property, publicity, or privacy rights;
• the content complies with these Terms, all applicable laws, and any applicable third-party terms (including the terms of the games and platforms the content targets); and
• the content does not contain malware, spyware, backdoors, obfuscated remote kill switches targeting buyers, cryptocurrency miners, or any other harmful or deceptive code.

You are solely responsible for your User Content and for any claims, losses, or damage arising from it.

Unless the Creator specifies different license terms on the resource page, a download or purchase grants you a personal, non-exclusive, non-transferable, revocable license to use the Resource for operating your own game servers or projects.

Unless the Creator expressly permits otherwise, you may not:

• redistribute, resell, sublicense, leak, or publicly mirror a Resource or any part of it;
• share purchased files with persons who have not purchased them; or
• misrepresent a Resource as your own work.

Purchases are licenses to digital content, not transfers of ownership. Violation of license terms may result in revocation of access without refund, account termination, and legal action by the Creator or by us.

Paid transactions are processed by third-party payment processors (currently PayPal and Stripe). GameServersHub does not collect or store full payment card numbers. Your use of a payment processor is subject to that processor's own terms and privacy policy.

• Pricing. Creators set the prices of their Resources. Prices may change at any time; the price charged is the price displayed at checkout.
• Platform fee. GameServersHub deducts a platform fee from each sale (currently 10% of the transaction amount, subject to change with notice to Creators) before the remainder is made available to the Creator.
• Taxes. You are responsible for any taxes, duties, or government charges that apply to your purchases or sales, except where we are legally required to collect them.
• Payouts. Creator payouts are made through the payout provider the Creator has connected (PayPal or Stripe). We may withhold, offset, or reverse payouts where we reasonably suspect fraud, refund abuse, chargebacks, infringement, or violations of these Terms.
• Chargebacks. Initiating a fraudulent or abusive chargeback is a violation of these Terms and may result in immediate account termination and revocation of all licenses.

Because Resources are digital goods that are delivered immediately, all sales are final and refunds are granted at our discretion, except where a refund is required by applicable law. You may submit a refund request through the Platform; requests are reviewed case by case, taking into account factors such as whether the Resource is materially defective, materially misdescribed, or was never downloaded.

Nothing in this section limits any non-waivable statutory rights you hold as a consumer in your jurisdiction, including rights under EU, UK, or Australian consumer law where applicable. Where such law grants a mandatory remedy, that remedy applies notwithstanding this section.

You agree not to, and not to attempt to:

• upload or distribute content that is illegal, infringing, defamatory, hateful, sexually exploitative, or that harasses or threatens any person;
• upload or distribute malware, viruses, stealers, rats, loggers, or any code designed to harm, surveil, or deceive users;
• upload stolen, leaked, cracked, or pirated content, or content that circumvents licensing or digital rights protections of any third party;
• use the Services to violate the terms of service of any game, game publisher, or third-party platform;
• scrape, harvest, or bulk-download content, accounts, or data except through the documented public API within its rate limits;
• probe, scan, or test the vulnerability of the Services, bypass authentication or download protections, or access data not intended for you;
• manipulate reviews, ratings, download counts, or search rankings, or operate multiple accounts to evade enforcement;
• impersonate any person or entity, or misrepresent your affiliation with any person or entity; or
• use the Services to send spam or unsolicited promotions, or resell access to the Services without our written permission.

We reserve the right, at our sole discretion and without prior notice or liability, to remove, delist, edit metadata of, or disable access to any Resource or other User Content, and to suspend, restrict, or permanently ban any account, including where we believe, in our sole judgment, that the content or conduct violates these Terms, creates risk for the Platform or its users, infringes third-party rights, violates law, or harms the integrity or reputation of the Services. We may, but are not obligated to, provide notice or an explanation.

• Removal or delisting of a Resource does not entitle the Creator to compensation, lost profits, or reinstatement.
• Banned users are not entitled to a refund of purchases or fees, except where required by law.
• We may also remove content or terminate accounts that have been inactive for an extended period, or where required by our infrastructure, payment, or legal partners.
• You may stop using the Services and request account deletion at any time, as described in the Privacy Policy.

Sections of these Terms that by their nature should survive termination (including content licenses for delivered Resources, payment obligations, disclaimers, limitations of liability, and indemnification) survive termination of your account.

We respect intellectual property rights and expect users to do the same. If you believe content on the Platform infringes your copyright, send a notice to [email protected] with the subject line "DMCA Notice" that includes: (a) identification of the copyrighted work; (b) the URL of the allegedly infringing material; (c) your contact information; (d) a statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law; (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for the owner; and (f) your physical or electronic signature.

We will respond to valid notices, which may include removing or disabling access to the material. Affected users may submit a counter-notice with the elements required by 17 U.S.C. § 512(g). We maintain a policy of terminating, in appropriate circumstances, the accounts of repeat infringers.

Knowingly submitting a false infringement notice may expose you to liability for damages, including costs and attorneys' fees.

The Services integrate with and depend on third-party services, including Discord, Steam (Valve Corporation), PayPal, Stripe, and Cloudflare. Your use of those services is governed by their own terms. We are not responsible for the availability, accuracy, or conduct of third-party services.

All game titles, publisher names, trademarks, and logos referenced on the Platform (including names of games whose resources are listed or mirrored) are the property of their respective owners. GameServersHub is not affiliated with, sponsored by, or endorsed by any game publisher, Discord, Valve, PayPal, Stripe, or Cloudflare unless expressly stated.

Resource listings mirrored from external sources (such as public workshop catalogs) are presented for discovery; rights in that content remain with the original authors and platforms.

If you use our public API, you must comply with the published API documentation, authentication requirements, and rate limits. API keys are personal to your account; you are responsible for keeping them secret and for all use made with them. We may throttle, revoke, or suspend API access at any time, with or without notice, including for abuse, excessive load, or violation of these Terms. The API is provided as is, and we may change or discontinue endpoints at any time.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL RESOURCES AND CONTENT AVAILABLE THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT ANY RESOURCE IS SAFE, FUNCTIONAL, COMPATIBLE WITH YOUR SYSTEMS, OR FREE OF DEFECTS OR MALICIOUS CODE; THAT LISTINGS OR MIRRORED CATALOG DATA ARE ACCURATE OR CURRENT; OR THAT THE SERVICES WILL BE SECURE OR AVAILABLE AT ANY PARTICULAR TIME. YOU DOWNLOAD AND USE RESOURCES AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMESERVERSHUB AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR SERVER OR SYSTEM DAMAGE, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES OR ANY RESOURCE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED US DOLLARS (USD $100) OR (B) THE PLATFORM FEES WE ACTUALLY RECEIVED FROM YOUR TRANSACTIONS IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY FOR CERTAIN DAMAGES; IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED, INCLUDING LIABILITY FOR FRAUD OR FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE.

You agree to defend, indemnify, and hold harmless GameServersHub and its owners, operators, employees, and agents from and against any claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your User Content, including any claim that it infringes or misappropriates third-party rights; (b) your use or misuse of the Services or any Resource; (c) your violation of these Terms or of any law; or (d) transactions or disputes between you and any other user, including between buyers and Creators. We reserve the right to assume the exclusive defense of any matter subject to indemnification, in which case you agree to cooperate with us.

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Florida, United States, without regard to conflict of law principles, and subject to any mandatory consumer protections of your country of residence. Except where prohibited by applicable law, you agree that the exclusive venue for any court proceeding is the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.

Before filing any claim, you agree to first contact us at [email protected] and attempt in good faith to resolve the dispute informally for at least thirty (30) days. Any claim must be brought within one (1) year after it arises, to the extent permitted by law. To the extent permitted by law, you and GameServersHub each waive any right to bring claims as a plaintiff or class member in any class, collective, or representative proceeding.

We may modify, suspend, or discontinue any part of the Services at any time. We may revise these Terms from time to time; the "Last updated" date above reflects the current version. For material changes we will provide reasonable notice, such as a notice on the Platform or in our Discord server. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Services.

• Entire agreement. These Terms, together with the Privacy Policy and any Creator-specific license terms displayed on resource pages, are the entire agreement between you and us regarding the Services.
• Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions remain in effect.
• No waiver. Our failure to enforce a provision is not a waiver of the right to enforce it later.
• Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
• Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control.
